La Trappe (hereinafter referred to as: ‘LT’) wants to interact with you in a way that you feel comfortable with. In this privacy and cookie policy we set out what information we may ask from you, why we need that information, and how you can affect this.
This privacy and cookie policy applies to all websites, webshops, social media channels, (digital) actions, newsletters, promotions, etc. of LT and its underlying brands. This only involves information that is privacy-sensitive. Put briefly, this refers to all (unique) personal data relating or traceable to you.
When you use our products and services, we may collect personal data from and about you. This includes data you provide to us when buying products in our webshops, when filling in a contact form to contact us, or information we collect when you use our (mobile) websites, apps, webshops and other services, such as online promotions, events and actions, competitions and loyalty programmes.
We collect personal data to better tailor our products and services to your needs, based on the insights we gain from this data. We also do so for commercial purposes, namely to get a clearer idea of the products and services you are interested in as a user and to make the ads we show as relevant to you as possible.
This document sets out, among other things, how we handle your personal data, how and what information we (may) collect, and for what purposes we (may) use it. It also tells you how you can access your data, how you can change or delete your data, or have it changed or deleted, and who are the (possible) recipients of this data.
Personal data may only be processed if there is a legal basis for doing so. Legal bases on which LT may process your personal data include:
Consent: you have given your legally valid consent when you freely give us an informed and unambiguous indication that you consent to specific processing by LT, e.g. when you subscribe to an e-mail newsletter.
Necessary for the performance of a contract: LT may also process your personal data because this is necessary to perform a contract that you have entered or will enter into with LT, or to take steps at your request prior to entering into a contract.
Legal obligation: in some cases, LT must process your personal data to comply with a legal obligation to which it is subject. An example of this is the retention of certain data under tax laws.
Legitimate interest: LT may also process your data where this is necessary to protect its legitimate (business) interests or those of a third party, unless these interests are overridden by your interests, fundamental rights or freedoms. In order to determine whether processing can take place on this legal basis, the interests of LT (or a third party) are set off against those of the data subjects beforehand. For instance, processing may take place on this legal basis for the purpose of preventing fraud (if a prior and careful balancing of interests turns out in favour of the business interests).
LT processes personal data that is adequate, relevant and limited to what is necessary in relation to the purposes for which it is processed. To achieve this purpose LT processes for instance, but not exclusively, data about consumers and business relations. This may include processing the following data:
The above is a list of the data we might collect. However, that does not imply that we actually request and store all of them. For example, while for one service your e-mail address may be required, another may not need it, but may need you location.
You are not obliged to disclose your personal data when you communicate with us. You are at all times free to decide whether or not to provide your personal data.
However, in order to be able to use certain of our products and services, it is necessary to provide personal data. For example, if you buy a product in one of our webshops, we need your details to deliver the product to you (or have it delivered) and to be able to invoice you. If you want to receive a newsletter or create an account for a webshop or loyalty programme, for example, we need at least an active e-mail address.
We track your use of our services online through cookies. All LT websites and communication tools use the same system, allowing provided data to be combined.
In some cases, we combine your data with:
We use this data to create a profile and improve our services. If you object to LT combining your data, you can state this by using the contact form.
The retention periods for data processed by LT depend on the type of information and the purpose for which it was obtained. LT does not retain personal data any longer than is necessary for the purposes in question. By default, data is kept for up to one year, unless the law prescribes a longer period.
For example, emails containing offers may be sent for up to one year after you made a purchase. Financial data must in many cases be retained for seven years due to tax obligations.
This policy applies to the processing of personal data by LT, including all its affiliates and brands. LT is the controller in respect of the processing of personal data.
Where necessary for business processes, legal obligations, or agreements LT may share personal data with third parties. To ensure the same level of security LT enters into data processing agreements with third parties that process personal data for it. The parties with whom data is shared include providers of digital services, payment services, debt collection services, and advertising agencies.
LT ensures appropriate security measures when transferring personal data outside the EU.
Persons under the age of 18 are not entitled to use LT’s services.
You have the following rights:
Right of access: you have the right to inspect, free of charge, which personal data we process about you.
Right to rectification: If the personal data we hold about you is incorrect or incomplete, you can ask us to complete or correct your personal data.
Right to erasure: you have the right to have your personal data deleted if: (i) the data is no longer necessary for the purpose for which it was collected; (ii) you withdraw your consent to the processing (and there is no other legal basis for the processing); (iii) you object (with valid reason) to the processing; (iv) the personal data has been processed unlawfully; (v) this is required by law, or (vi) the personal data has been collected in the context of a so-called information society service. In some cases it is not possible to delete your personal data, for example if LT has a legal obligation to retain the data; if the data is necessary to be able to perform an agreement with you (e.g. the delivery of a product after it has been ordered in one of our web shops), or if the right to freedom of expression and information override this in a specific case.
Right to restrict processing: you have the right to request a restriction of the processing of your personal data (for example, while the accuracy of your personal data is being verified).
Right to data portability (“data portability”): under certain conditions you have the right to receive the personal data you have provided to us in a structured, commonly used and machine-readable format and to transfer your personal data to a third party of your choice.
Right to object: you are entitled to object to the processing of your personal data on grounds relating to your particular situation. In that case, a balancing of interests will take place taking into account your specific situation.
Furthermore, you always have the right to lodge a complaint with LT or with the data protection supervisor; in the Netherlands this is the Autoriteit Persoonsgegevens. You may also tell us that you no longer want your personal data to be disclosed to group companies or third parties; that your personal data is combined into a profile, or that your data is used for making you targeted offers or receiving information and offers by e-mail.
